The EU Artificial Intelligence Act officially entered into force on August 1, 2024, and became the first ever comprehensive legal framework on AI worldwide, ensuring that AI systems follow fundamental rights, safety and ethical principles. Meanwhile, there is no federal legislation in the USA yet, so the state of California is taking the lead with a series of AI-related bills aiming to balance innovation with the need for transparency, privacy and consumer protection in the rapidly evolving AI landscape.

AB 3211 is one of the most important bills that has been in the press these past few weeks. It will allow for the general population to distinguish between human-generated content and synthetic content generated by GenAI models, as it requires tech companies to label AI generated content. One of the most time-sensitive reasons for the urgency of this legislation is the upcoming presidential elections and the need to control deepfakes spreading misinformation about political candidates.

A more controversial bill, SB 1047, aims to regulate AI development at the model level, mandating that developers put safety measures in place for their largest AI models that cost more than $100 Million to train. While the leading tech companies in the AI community are opposing this bill, top scientists, including the “Godfathers of AI” Yoshua Bengio and Geoffrey Hinton are urging its passage: “Throughout our careers, we have worked to advance the field of AI and unlock its immense potential to benefit humanity. However, we are deeply concerned about the severe risks posed by the next generation of AI if it is developed without sufficient care and oversight.” You can read the full letter from the AI experts at the link below:

Anytime the EU and California take the lead on anything, you can bet that the laws they are trying to pass are meant to do exactly the opposite of what they are telling you it's for.

this bill is too early, need to pass crypto law instead, AI is just an intent to something, very vague, how can you pass a law for something that hasn't matured yet
