Abstract:
Dissertation Submitted to Jawaharlal Nehru University In Partial Fulfillment of the Requirement for Award of the degree of MASTER OF PHILOSOPHY.

The root causes of the GCC's employment problems are interlocked – a system of national education that has largely not been competitive or well aligned with the needs of modern industry, a culture of citizens conditioned to a protective government, a public sector that is overstaffed and inefficient, and counterproductive policies in areas such as immigration and social welfare. It is also reflected in the highly distorted labour market in the region, founded on a socio-ethnic duality. In some respects the labour market is rigid, with pronounced differences in the wages for non-nationals and nationals. In other aspects it is flexible as current laws make it very easy to import or deport foreigners based on hiring/firing. This is also why“unemployment” is a national issue, for if and when a foreigner‟s work visa is terminated, he or she is obliged to return to the home country.
In the final analysis  –
• At the GCC level, the dissertation research disproves the hypothesis that growing numbers of GCC nationals have entered the private sector due to workforce nationalisation programmes, replacing foreign labour.
• The second hypothesis has been validated in that the growing mismatch between available local labour and the labour market requirements has undermined the success of Emiratisation.
• Finally, the failure of Emiratisation has been concluded while validating the hypothesis that Indian labour migration to the UAE has been vigorous despite Emiratisation.

The number of the second generation of Shan migrants in Thailand has steadily increased. Previous studies have shown that they have formed a new identity through education and living in Thailand, and become cultural hybrids. This paper aims to investigate the adaptation of the second generation of Shan migrants from Myanmar through education and living in Thailand. The study employs a concept of cultural hybridity which is interpreted as a dynamic process to shed light upon the complexity of adaptation of the second generation of Shan migrants under the context of marginal people in Thai society. This paper is a preliminary analysis using a qualitative approach. Data were collected through document research, fieldwork, and in-depth interviews with the second generation of Shan migrants in Chiang Mai between 2018 and 2019.

The aim of this policy brief is to provide some understanding of the health constraints faced by single male laborers (SMLs), the policy efforts underway to enhance their access to healthcare, and further actions that ought to be undertaken to strengthen and improve healthcare for this group of migrant workers in Qatar.

This thesis concerns the existence of runaway migrant workers in Taiwan, mainly Indonesian. Despite well-publicized horrifying accounts of abuse, exploitation, rape, forced confinements, and executions without trial, Indonesia migrant workers appear to remain hopeful in their decision to migrate. To most

‘Post-national’ scholars have taken the extension of social rights to migrants that are normally accorded to citizens as evidence of the growing importance of norms of ‘universal personhood’ and the declining importance of the nation-state. However, the
distinct approach taken by the state toward another understudied category of noncitizen – stateless people – complicates these theories by demonstrating that the state
makes decisions about groups on different bases than theory would suggest. These findings suggest the need to pay more attention to how the state treats other categories of ‘semi-citizens’. This article examines the differential effects of universal healthcare reforms in Thailand on citizens, migrants, and stateless people and explores their ramifications on theories of citizenship and social rights. While the state has expanded its healthcare obligations toward people living within its borders, it has taken a variegated approach toward different groups. Citizens have been extended ‘differentiated but unambiguous rights’. Migrants have been granted ‘conditional
rights’ to healthcare coverage, dependent on their status as registered workers who pay mandatory contributions. Large numbers of stateless people, however, saw their right to state welfare programs disenfranchised following passage of the new universal healthcare law before later being granted ‘contingent rights’ through a new program.

This article examines the legal framework regulating unskilled and low-skilled migrant workers
in Singapore. It argues that the current legal framework discriminates against these migrant
workers and conceptualizes them as undesirable for inclusion in the wider society. This, it is
contended, is premised on the assumption that migrant workers could be sequestered from the
local population to some extent. This article provides some challenges to this assumption,
highlighting instead some of the broader social and political consequences of this exclusionary
legal framework. Consequently, it is argued that a more inclusive and integrationist approach
is needed, and some positive developments are highlighted.

This article explores the various ways in which noise acts as an aesthetic marker of precarity in Nick Broomfield's Ghosts, a documentary account of the death of 23 undocumented Chinese nationals in the United Kingdom in 2004. Taking its cue from recent work on aesthetics and the temporalities of precarity, it considers the ways in which the different forms of noise-medial and informational-index the ways in which the figure of the undocumented migrant labourer disturbs dominant western accounts of the aesthetic predi-cated on a division between production and consumption. Noise, in the form of Michel Serres' conceptual figure of the parasite, it argues, registers the ways in which precarious labour has revealed the dependence of aesthetic categories on models of production rendered incoherent by the representation of undocumented migrant labour.

1. Our recommendations help –

A. Entrepreneurs to downsize, right size or close their enterprise without government permission.
B. But, all workers who have been laid off must get PF and Severance Pay (as in Europe and Brazil)

2. Therefore we are AGAINST THRESHOLDS. Entrepreneurs and Workers suffer because of TWO THRESHOLDS.
A. SIZE: Units with 100+ workers suffer many restraints to Labour flexibility. This is disagreeable to Entrepreneurs.
B. DURATION: Only workers who have been employed for over 240 days are entitled to benefits. This seriously disadvantages workers.

We are against all thresholds as they:
i. Encourage small enterprises and not big scale, high technology ones
ii. Encourage employment of non-permanent casual workers; this blocks skill development

3. ALL WORKERS ARE ON THE MUSTER and are entitled to all benefits.

4. When worker is retrenched/laid-off, the benefits over and above PF, Bonus also includes SEVERANCE PAY (as in Europe and Brazil). We have allowed for exceptions in “Seasonal Industries”, but there are certain constraints in this sector too.

5. So now no enterprise gains from being
A. Small and Employing below 100 workers
OR
B. Firing workers before 240 days of Employment are over

6. So hiring contract /casual workers now become less attractive.
     
THEREFORE:
A. All workers hired for non-core jobs must come from a contractor’s firm where this job is a core one
B. All contract workers, no matter where they are currently hired to work, are on the Muster of their parent firm

7. On Dispute Resolution we suggest:
A. One Workers’ Council whose office bearers are elected by universal secret ballot BUT only by those inside the company.
B. Trade Unions can function within but the body representing workers will be the Workers’ Council.

8. Also a Three Tier Dispute Resolution Mechanism is suggested.
A. Workers’ Council, whose office bearers will be internal and elected internally as well.
B. Conciliation Committee, which will have labour representatives.
C. Labour Tribunal.

The time taken at each level is fixed without exceptions.

The current state of art report aims to enquire on the actual situation in Italy by combining a literature, policy and procedure review on the following topics: migrants and refugees’ employment & unemployment rates, as well as their educational status, theoretical and methodological approaches of migrants and refugees’ integration into the labour market; together with a field research analysis conducted through the delivery of  questionnaires and focus groups among migrants, refugees and stakeholders in Sicily.

One of the examples of governance practice is cooperative.
In Malang City, there is a cooperative named ‘Koperasi TKI Purna Citra Bumi Mandiri’ that is established by the former migrant worker, Winarti. She dedicates this cooperative for the former migrant workers in Malang who have been dismissed from their job because of global economic crisis.
As we know, the global economic and social crisis that happened not only in Indonesia, but also in the world, have been gave a bad impact to the migrant workers life. Some of them have to be laid-off from their job. Tragically, when they returned to Indonesia, they could find job to fulfill their life.
The TKI Purna Citra Bumi Mandiri cooperative works together with ILO (international Labour Organization) in East java, to stimulate the former migrant business skills. They train the other former migrant how to improve their own business skills and create job so they can be able to build their better life.

With the growth of Asian economies, reliance on the supply of migrant workers has become more important to sustain competitiveness especially in labor-intensive sectors. Malaysia, for one, is a large importer of labor in the region. An estimated 16 per cent of the country's total employed workforce is comprised of foreign workers with vital communication and information needs. The paper examines how mobile phones have become significant devices for migrant workers to adapt to new environments. The paper looks into: (1) the information and communication needs and practices specifically of Indonesian, Filipino, and Bangladeshi migrant workers in Malaysia (2) their aspirations and interests on entertainment, local content, and media consumption; and (3) their social networks in their host environments. Through in-depth interviews and photo novellas (picture stories), the paper investigates how migrant use of mobile phones paves the way for forming and maintaining social circles that are integral in their lives away from home. The lifestyles and mobile phone culture of selected Filipino, Indonesian and Bangladeshi migrant workers in Kuala Lumpur, Malaysia reflect how links with their own home countries are sustained with mobile technology as a tool. The paper hopes to shed light on the role played by mobile usage in building social capital and inclusion among migrant workers in Malaysia.

Situating LGBT activism in a gendered, Asian migratory context, this study asks why and how LGBT migrant workers are able to organize themselves and come out publicly as lesbians, bisexual women, or transgender people in Hong Kong. Which factors are enablers for this phenomenon? A comparison of two migrant groups, namely, the Filipinos and Indonesians, who reside in the same city, will shed light on both the commonalities and diversities of their understanding of LGBT rights as well as their approaches for engaging in the LGBT movement.
The study examines the different immersed contexts of the two migrant groups rather than homogenizing “migrant domestic worker” as a universal description of these women. The study adopts an intersectional approach to examine how multiple subject positions, including gender, race, class, and non-citizen status, affect migrant domestic workers who have a same-sex relationship in the host city aswell as their practices and activism. Besides, it also adopts an inter-Asia approach to shed light on the flows of knowledge aswell as inequalities among Hong Kong, the Philippines, and Indonesia and provide insights into how LGBT activism in Asia is culturally hybrid and diasporic. Qualitative research methods, including participant observation and in-depth interviews, were conducted from 2016 to 2018. I attended LGBT parades and events and conducted in-depth interviews with three Filipinos, two Indonesians, and two Hong Kong people. I also used data from my earlier field work in 2010 to 2012.

This is a memoir about how I survived war, patriarchies, and dictatorship. I was born in 1936 in Bonuan Gueset, Dagupan City, Pangasinan, Philippines. Some Third World economies depend on the economic and social remittances of overseas workers and yet our contributions are undervalued. I share my insights on the obstacles to girls and women's education and the resources that enabled me to survive and thrive.

For super-diversity to describe the diversification of Asian global cities, it should be discussed with reference to existing regimes governing diversity. In Singapore, the postcolonial state instituted the multiracialism of equality between the ‘races’ of colonial governmentality, so as to manage the ethnic diversity of ‘the plural society’. However, contemporary immigrations disrupted this multiracialism. The political response focused on managing the mobilities of low-wage migrant workers. Drawing on my research on urban change, I show that the this led to the biopolitical management of migrant worker mobilities and articulation of the discourse of needs. I argue that the 2013 riot by migrant workers accelerated the production of dormitory space to exclude migrant workers from access to the city and reproduce their physical needs. The case of Singapore shows that we need to ‘moor’ the understanding of super-diversity in Asian global cities to the postcolonial management of diversity and migration.

and Citizenship addresses how Islamic ethical and legal traditions can contribute to current global debates on migration and displacement; how Islamic ethics of muʾākhā, ḍiyāfa, ijāra, amān, jiwār, sutra, kafala, among others, may provide common ethical grounds for a new paradigm of social and political virtues applicable to all humanity, not only Muslims. The present volume more broadly defines the Islamic tradition to cover not only theology but also to encompass ethics, customs and social norms, as well as modern political, humanitarian and rights discourses. Since the mid-2000s Vietnam has become an important manufacturing hub in garment and, increasingly, in electronics. However, the expansion of an FDI-dominated, export-oriented manufacturing did not contribute to a genuine national industrialisation process and the weight of manufacturing on GDP has actually declined. Low industrial wages (associated with poor working conditions) have emerged as a structural (rather than transitory) competitive factor for the country’s participation in global production networks.

Whereas the exile is associated with high culture and the sublime, non-material world, the migrant milieu is linked with low culture and the material, corporeal world, ruled by money, absorbing and dehumanizing human lives. Migrant workers do not populate imaginative " third worlds " , but material non lieux – transitional places on the brink of the society without tradition and identity. Although they constantly swing between two countries, their culture is not perceived as a dynamic, moving one, but as a sedentary one. Whereas intellectual elites belong at the same time to the culture of home and host land, migrant workers are excluded from both of them, being incompatible even with patriotic concepts of the home land. The paper outlines the main characteristics and modes of representation of migrant culture on some examples from the visual culture, painting and film from the former Yugoslavia.

Resumen:
Han pasado casi seis décadas desde que La imagen de la ciudad de Kevin Lynch lograra posicionarse en la academia global como una metodología relacional para entender la morfología de la ciudad. Si bien este concepto se mantiene dentro de las premisas urbanas vigentes y con aplicación sobre los procesos de diseño y mejoramiento en barrios y ciudades, se requiere de nuevas visiones que integren el actuar de los residentes, retratadas por medio de sus propios imaginarios. El presente artículo posiciona el debate y la aplicación de la imagen urbana desde una visión dinámica, emergida desde la revisión del propio Lynch (1995) que puede aplicarse en las actuales prácticas socioespaciales de migrantes latinoamericanos en centros urbanos, y cómo sus imaginarios urbanos se transforman en activos culturales. Situados en la calle Maruri, en Santiago de Chile, se adopta un enfoque cualitativo multidisciplinar que combina el análisis clásico de la imagen urbana de Lynch (1960) con registros visuales en esta área central, de manera de comprender la experiencia del residente migrante respecto de sus apropiaciones del espacio público. Los resultados muestran que estas prácticas socioespaciales de los migrantes, en tanto nuevos residentes, están permitiendo amplificar el significa-do y uso de la calle, reactivando espacios de transición como la fachada y la platabanda con nuevos usos que prolongan la actividad barrial y la integración cultural. Se concluye que el vínculo entre "imagen e imaginario" requiere una relación recíproca e indisoluble para ser transformada en normativa urbana y, de esta forma, permear en la planificación urbana en materia de integración social y programas específicos de mejoramiento barrial.

Abstract:
It has been almost six decades since The image of the city of Kevin Lynch became a key methodology in the global academia to understand the morphology of the city. Although this concept remains within the current urban principles and also applies to the processes of design and improvement in neighbourhoods and cities, new approaches are required to include the actions of the residents and their own imaginaries. This article debates the application of the urban image from a dynamic vision, emerging from Lynch (1995) to be applied in the current socio-spatial practices of Latin American migrants in the inner city, and how their urban imaginaries are transformed into cultural assets. Located on Maruri Street, in Santiago of Chile, a multidisciplinary qualitative approach is proposed which combines the classic analysis of the urban image of Lynch (1960) with the ethnographic study in this historical area, including the migrant resident's everyday life and visualizations in the public space. The results show that these socio-spatial practices of migrants as new inner residents help to amplify the sense and use of the street, reactivating transitional spaces such as the facade and tree strips with new uses that increase both neighbourhood activity and cultural integration. It is concluded that "image and imaginary" require a closer and better relationship to be included in urban regulations and planning in terms of social integration and specific neighbourhood improvement programs. For all of human history, people have been involved in the process of migration for livelihood. The changing trends and challenges of migration seem to differ in developed and developing countries like India – a land of high migration. UNESCO (2013) claims three out of ten Indians are moving across the state for livelihood - more than 400 million people. This movement has impacted as population shift, a rural-urban developmental divide and in unequal modes of development in the southern and northern parts of India. A recent trend is the shifting of the labour force from rural areas of the northern states into the comparatively more developed parts of the southern state of Kerala. Kerala itself is noted for high out-migration overseas to the Gulf and other developed nations, as well as for high education and skills levels and a reluctance among youth to take up non-white collar work.  This leaves gaps in the state in unskilled and manual labouring sectors and in the unorganised economy.  Internal migrants from north India are filling these gaps and Kerala is becoming the ‘new Gulf of India’, with a population of 30-40 lakh inter-state migrant workers. This  study explores these changing trends, via interview work with a focus on the attitude and perception of government stakeholders and migrant workers in the state. The research used snowball sampling to gather 60 respondents who are ‘government stakeholders’ - ranging from district and assistant labour officers, police officials, to judges and advocates, all of whom are directly involved in management of and who have some exposure to the issues of migrant workers in the state. The paper contributes new understandings to public debates about migration and emphasises the need for shifts in role and attitudes among government stakeholders and internal migrants.

The number of problems of migrant workers has been bothering public conscience widely, ranging from cases of deportation, persecution, rape, and even death threats to the workers. The Government considered not doing its job in protecting the workers optimally especially in the diplomatic process. The workers do not have bargaining position steadily that weaken them so that arose the case and issues of migrant workers abroad. UU PPTKILN which has been legalized since 2004 was less able to base the protection of migrant workers abroad. This encourages the study of policy analysis to the migrant workers protection and result the idea that the law (UU PPTKILN) should be revised accordance with the Convention on Migrant Workers and regulate the rights and obligations of migrant workers in a comprehensive manner and uphold the dignity of workers. The government firmness needed to regulate and solve these problems not only inside but also outside (the destination countries of migrant workers).

"The Criminalization of Immigration: Contexts and Consequences explores these competing narratives and the consequences of criminalizing immigration in the United States and abroad. It examines the impact of national, state, and local legislation on the psychosocial well being of immigrants. The book explores key ways in which immigration is criminalized, and examines how the problematization of immigration becomes a political tool. The first chapters of the book explore the criminalization of immigration through the lens of pacification and the theater of cruelty. In both chapters, the authors seek to understand the process of “othering” members of the immigrant population to exact social control and to mollify the public. These front chapters set the tone for remainder of the book. They provide the impetus for why states have enacted, or have attempted to enact state level immigration laws that make it nearly impossible for the undocumented to live within the boundaries of these states. In section two, three U.S. states are highlighted: Arizona, Alabama, and Indiana. While the chapters on Arizona and Alabama summarize key aspects of state laws, author Sujey Vega highlights the life of one undocumented immigrant as she navigates life in the Heartland.

The book then turns its focus to the criminalization of immigration in a socio-political context. Here, four chapters provide explorations of the criminalization of immigration on labor standards enforcement, immigrant detention, the right wing perspective in the United States and in Europe, and white supremacy. Labor standards impact the rate by which undocumented immigrants are paid, which in turn impacts their health and safety within and outside the workplace, protections from workplace discrimination, and collective activity protections. The criminalization of immigration erodes many of the workplace and labor protections that we have come to view as essential. Similarly, the privatization of corrections has influenced the incarceration and detention of many undocumented immigrants and has even influenced the very laws described in section two of this book. If not for the possibility of profiting off of the detention of the undocumented, many of immigration related laws would not have come to fruition.

The next section of the book provides a transnational and international context to the criminalization of immigration. With chapters focusing on human rights violations, the transnational dimensions of Mexican migration, the making of the Maras, and the criminalization of immigration in the United Kingdom, these chapters ask the reader to examine the criminalization of immigration from a broader perspective. The reader learns how national issues become international and, likewise how international immigration issues influence national policy.

The final chapters of the book put the human face on the criminalization of immigration. Each chapter represents a case study of a specific aspect of the criminalization of immigration. They approach the issue from the viewpoint of a day laborer, an undocumented woman who has become a victim of domestic violence, a child whose parents are undocumented, and a detention officer who wrestles with his decisions to continue his job. Regardless of which chapters one reads, the raw emotion felt by placing oneself in each context is overwhelming.

Overall, The Criminalization of Immigration: Contexts and Consequences provides a complete examination of an issue that cuts through emotional value conflicts. It provides the facts and knowledge essential for a fair and balanced debate"

This is the final, edited version of an original 2hours interview recorded live on skype in March 2020. Zhang Ruiqi and Cai XIngyang approached me from NY and asked me if I wanted to answer some questions about the activity of the Social Sensibility R&D Departments in Beijing and in Paris/Gonesse. Aiming at contributing to the limited literature on migrant labor in Qatar, this project investigated the current situation of low-skilled migrant workers in Qatar through an analysis of newspaper articles and interviews. 542 articles from two Qatari local newspapers in English that depicted stories of migrant worker issues were collected and analyzed using grounded theory. In addition, interviews with migrant workers, employers, ambassadors, and community advocates offer insights about the living and working conditions of migrant workers in Qatar. In line with the limited literature on this topic, the findings indicate that migrant worker face various challenges starting in their country of origin with the use of unscrupulous recruiting agencies and constrained by the sponsorship system and the labor laws in Qatar. Specifically, challenges include falsification of work related documentation, long work hours and low salaries, unpaid wages, exploitation and abuse in the work place, unsafe working conditions, poor accommodations, medical problems, and accidents and fatalities. The findings also highlight the role of government and non-government agencies and embassies in providing aid and assistance to workers in need. Initiatives taken by the Qatari government to better protect the rights of migrant workers are also discussed. The corpus analysis and interview data also points out the perceived negative cultural, social, and economic impact that migrant workers bring to the State of Qatar. Recommendations for policy implementation to protect the rights of migrant workers in Qatar are discussed.

This article discusses a unique cultural politics of identity affirmation and resistance enacted in the rural spaces of Greece by male migrants from India and Pakistan through the game of Kabaddi, a rural indigenous sport. Drawing on interviews with South Asian migrant men and observation of Kabaddi tournament in Greece, it argues that the play of Kabaddi offers deliberate performative acts of masculine resistance against the emasculatory bordering regimes of illegality, deportability and racial otherness. Kabaddi tournaments occur as highly masculinised, public, collective, celebratory, yet potentially subversive spectacles. Kabaddi allows South Asian migrant men to acquire culturally specific masculine capital through displays of muscular masculinity. As spectators and participants, they collectively engage in cultural affirmation and wresting subjectivity against bordering regimes that subjugate racialised migrant men into (im)mobility, enforce labour disciplining and invisibility and emasculate them into abjectivity.

No existing review has synthesized key questions about acculturation experiences among international migrant workers. This review aimed to explore (1) What are global migrant workers' experiences with acculturation and acculturative stress? (2) What are acculturative stress coping strategies used by migrant workers? And (3) how effective are these strategies for migrant workers in assisting their acculturation in the host countries? Peer-reviewed and gray literature, without time limitation, were searched in six databases and included if the study: focused on acculturative stress and coping strategies; was conducted with international migrant workers; was published in English; and was empirical. Despite migrant workers having a continuous presence in the German labour market since the 1950s, the children and grandchildren of these guestworkers are often still regarded as second-class citizens and, in many cases, still struggle to accessGerman citizenship. The far-right AfD’s entrance into Germany’s parliamentary landscape has shifted
politics of citizenship even further to the right, with Chancellor Angela Merkel’s government now having passed numerous bills curtailing the right to asylum, restricting dual citizenship and thus negatively
impacting on integration policies.

It is against this background that this article seeks to outline German trade unions approach to migrant workers from the first guestworker programmes to today, underlining some of the persistent challenges
which German trade unions have overcome in the past, face at present and will have to address in years to come.

Women are increasingly migrating as foreign domestic workers (FDWs), transferring their feminized labor from their homes in the Global South to their workplaces in the Global North. While FDWs play a central role in freeing class-privileged women from the responsibilities of housework, therefore allowing them to participate in the economy, domestic labor has long been undervalued, underpaid, and unprotected in many societies.

In an unprecedented move, Japan recently initiated a plan to accept FDWs from the Philippines in three National Strategic Special Zones (NSSZs), as part of Prime Minister Shinzo Abe’s “Womenomics” strategy to promote women’s workplace participation. Given Japan’s long-standing resistance to immigration, this plan appears particularly counterintuitive. By crossing national borders and entering the private homes of families, FDWs will commit a double intrusion into the Japanese lifeworld – an unimaginable reality for many. This thesis hence studies the ways the state reimagines and reconfigures traditional ideas of (foreign) domestic work to recognize the FDW as a skilled and hence valuable addition to the Japanese society. Japan’s unique approach to adopting domestic labor is significant in reframing perceptions of FDWs – not just as “dirty workers” relegated to the bottom of the “global care chain”, but as professionals providing a niche service.

Beyond Japan, this thesis is also interested in how the FDW Project is taking shape through the uneven relations between the state apparatuses of Philippines and Japan. The protection of FDWs’ rights is negotiated horizontally between sending and receiving nations, coupled with enforcements from international organizations from “above” and non-profit organizations from “below”. Given the global nature of this phenomenon, I approach this study by simultaneously considering the experiences of other FDW-receiving countries.
